Terms of Use

These terms (“Terms”) are an agreement between you and Techmely (“we”, “us”) about your use of the mobile game Lumiriver (the “App”). By downloading or playing the App you accept these Terms and our Privacy Policy. If you do not agree, please do not use the App.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to download and play the App on devices you own or control, for your own non-commercial entertainment. The App is licensed, not sold. If you downloaded it from the Apple App Store, Apple’s Standard End User License Agreement also applies; if anything conflicts, these Terms prevail to the extent allowed.

2. Age

The App is intended for a general audience. If you are under the age of majority where you live, you must have a parent or guardian’s permission to use the App and to make purchases.

3. Virtual items and purchases

• The App contains virtual items such as coins, stars, boosters and lives. They have no real-world monetary value, cannot be exchanged for cash, and can only be used inside the App.
• You may buy optional items (Remove Ads, Starter Pack) through the Apple App Store or Google Play. Payments, refunds and billing are handled by Apple or Google under their terms; we do not see your payment details.
• Purchases you own can be restored on a new device with Restore Purchases in the Shop or Settings, using the same store account.
• Your progress and virtual items are stored on your device. If you delete the App or lose your device, progress that is not tied to a purchase may be lost.
• We may change the price, availability or behaviour of virtual items, for example to balance the game.

4. Advertising

The App is free and is supported by advertising, including optional rewarded videos. Ads are provided by third parties and are subject to their terms. We are not responsible for the content of third-party ads or websites they link to.

5. Acceptable use

You agree not to: copy, modify, decompile or reverse-engineer the App except as permitted by law; cheat, exploit bugs, use bots or tools that alter the App or its data; interfere with ads or our partners’ services; or use the App for any unlawful purpose.

6. Intellectual property

The App, including its code, art, music, characters, levels and the name “Lumiriver”, belongs to Techmely or its licensors and is protected by intellectual property laws. Fonts are used under the SIL Open Font License.

7. Updates and availability

We may update, change or stop offering the App or any feature at any time. Some updates may be required to keep playing. We do not guarantee that the App will always be available or free of errors.

8. Disclaimer

The App is provided “as is” and “as available”, without warranties of any kind, to the fullest extent permitted by law.

9. Limitation of liability

To the fullest extent permitted by law, Techmely will not be liable for any indirect, incidental, special or consequential damages, or loss of data or virtual items, arising from your use of the App. Our total liability to you is limited to the amount you paid us for the App in the 12 months before the claim. Nothing in these Terms limits rights you have as a consumer that cannot be limited by law.

10. Termination

You may stop using the App at any time by deleting it. We may suspend or end your licence if you break these Terms.

11. Governing law

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in your local courts.

12. Changes to these Terms

We may update these Terms. We will change the “Last updated” date above; continuing to use the App after a change means you accept the new Terms.
